Five Iron Golf – Holiday Sales Terms & Conditions

GIFT CARD, LESSON, SWING EVALUATION, AND LESSON PACKAGE PURCHASES

Five Iron Golf gift cards sold from November 18, 2024 through December 31, 2024 come with the following additional dollars (pre-loaded on the purchased card) in addition to free branded merchandise at the $250 and $500 levels as stated below: 

$75 Gift Card – $10 Bonus = $85 Total Value

$125 Gift Card – $25 Bonus = $150 Total Value

$250 Gift Card – $65 Bonus = $315 Total Value (also comes with a free 5i beanie)

$500 Gift Card – $150 Bonus = $650 Total Value (also comes with a free 5i hoodie)

Gift cards are non-refundable and are eligible for redemption on booking hourly simulator rentals, individual lessons, lesson packages, the Swing Evaluation, or the Intro to Golf lesson. They cannot be used towards membership payment or as account credit. Same-day use of purchased Gift Cards is prohibited. Limit one (1) Swing Evaluation and/or Intro to Golf lesson per Mindbody account. Pricing may not be combined with other offers or discounts nor can the bonus bucks that are applied to special offer gift cards be applied to discounted or promotional items. WEEKLY GIVEAWAYS

How to Enter. You may enter the Giveaway by:

(1) purchasing a gift card online at https://store.fiveirongolf.com/pages/gift-cards-page; 

OR 

(2) mailing a 3×5 inch notecard with your name, mailing address, phone number, and email address to: Five Iron Golf, Attn: Giveaway, 883 Avenue of the Americas, Floor 3, New York, NY 10001 (“AMOE Notecard”). Your AMOE Notecard(s) must be postmarked by the relevant deadline and received at the above address by the relevant drawing deadline to be included in that week’s giveaway; if your AMOE Notecard is not received by December 31, 2024, it will not be included in any drawings for the Giveaway. You may mail up to 20 AMOE Notecards per week, each of which will constitute an entry for the following week’s drawing. There is a limit of one (1) AMOE Notecard per envelope. Each envelope/AMOE Notecard is considered one (1) entry into the Weekly Giveaway. No mechanical reproductions will be accepted. AMOE Notecards must contain all entry fields outlined above; otherwise, they are void and will not be eligible to win.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A purchase or payment does not increase a person’s odds of winning a prize. 

Criteria: The Weekly Giveaways start on November 20, 2024. Six weekly drawings will occur, no less than two (2) days after each deadline. The deadlines to enter are 2:00pm Eastern Time on each of the dates listed in the chart below. Winners will be selected at random from the group of eligible gift cards purchased online by the deadline and eligible AMOE Notecards received by the drawing date each week. Winners will be announced on Instagram/other social media channels and contacted by email (or phone, if you do not have an email address).

By entering a Five Iron Golf Giveaway (each, a “Giveaway”), you will be bound by these Giveaway Terms & Conditions and our Privacy Policy and you acknowledge that you satisfy all eligibility requirements. “Five Iron Golf” means The Range NYC LLC d/b/a Five Iron Golf or any of its affiliates.

Eligibility: The Giveaway is open to individual legal residents of the 50 United States or the District of Columbia who are the legal age of majority in their state of residence prior to the date of entry. Employees of Sponsor are not eligible to participate. The Giveaway may only be entered in or from the fifty (50) United States, the District of Columbia; entries originating from any other jurisdiction are not eligible for entry. All federal, state and local laws and regulations apply.

Prize(s) and Winner Selection Method. The Sponsor will award a prize to one or more individuals who enter using one of the two methods identified below. Potential winner(s) will be selected at random from among all eligible entries received. Odds of winning depend on the number of eligible entries received. If you are a winner, an email notification will be sent to you from Five Iron Golf on behalf of the Sponsor (or Five Iron Golf will call your phone number if you do not have an email address).

Prize(s) will be fulfilled by the Sponsor. Prize(s) will be delivered by Five Iron Golf or one of its affiliates or by the Sponsor using the shipping address you select for the Giveaway. Each winner will be responsible for paying any taxes and any other expenses incurred, including any income taxes, sales or use taxes, value added taxes, goods and services taxes, or harmonized sales taxes. You will provide Five Iron Golf with any forms, documents, or certifications as may be required for Five Iron Golf to satisfy any information reporting or withholding tax obligations with respect to any payments related to this Giveaway.

Each prize will be awarded “as is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). If you win a prize, you may not transfer, assign, or redeem the prize for cash. The Sponsor or Five Iron Golf may substitute a prize with a prize of equal or greater value.

Restrictions: Each person may purchase an unlimited quantity and value of gift cards online per week, but only up to $1,000 of online gift card purchases per person per week will constitute entries for that week’s drawing (i.e., up to 8 entries per person per week maximum). Alternatively, each person may mail up to 20 AMOE Notecards per week, each of which will constitute an entry for that week’s drawing. Limit of one (1) prize per person/household. In-store gift card purchases are not eligible for this Giveaway. 

List of Winners: A list of winners may be obtained by mailing, within thirty (30) days of the date the final week’s winner was announced, a written request for such a list, with a self-addressed/stamped return envelope, to Five Iron Golf, Attn: Holiday Giveaway, 883 Avenue of the Americas, Floor 3, New York, NY 10001.

Additional Terms. Sponsor, together with Five Iron Golf, reserves the right to modify or cancel a Giveaway at any time. Sponsor and Five Iron Golf and its affiliates are not responsible for: (a) lost, misdirected, late, or incomplete entries or for inaccurate entry information; (b) any operation or transmission error, theft, unauthorized access to, or alteration of, entries; or (c) damage to any computer or device resulting from downloading Giveaway materials. Sponsor, together with Five Iron Golf, may disqualify any individual found to be: (x) tampering with a Giveaway; (y) violating these Terms & Conditions; or (z) acting in an unsportsmanlike or disruptive manner or with intent to threaten or harass any person. Incomplete and robotic, automatic, programmed or similar entries will be disqualified. The authorized subscriber of the account used to enter a Giveaway at the actual time of entry will be deemed to be the participant and must comply with these Terms & Conditions in the event of a dispute as to entries submitted by multiple users having the same email account.

No greater than the number of prizes stated above will be awarded. If any errors occur in the selection of a potential winner, or if more prizes are claimed than specified, Sponsor or Five Iron Golf may award the prize(s) by random drawing from among all eligible claimants. All prizes made available for a Giveaway may not be awarded in the event Sponsor or Five Iron Golf does not receive a sufficient number of qualified and eligible entries for an applicable Giveaway. Potential prize winners consent to the use of his/her name, likeness, biographical information, and voice in advertising worldwide without additional compensation (TN residents will not be required to sign a Publicity Release as a condition of winning a prize).

Miscellaneous. Each Giveaway is governed by the laws of the United States. By entering a Giveaway, you agree (for yourself and your heirs) that Sponsor, Five Iron Golf, and each of their respective affiliates and agents, and any entity involved in any aspect of the Giveaway (all aforementioned parties are collectively, the “Released Parties”) will have no liability, and will be held harmless from and against liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in the Giveaway, even if caused or contributed to by the negligence of any of the Released Parties.

You agree that Sponsor’s decisions related to each Giveaway and all distribution of prizes are final. Each winner agrees that, by participating in a Giveaway, Sponsor, Five Iron Golf, and their respective affiliates may use the winner’s name in any manner and in any medium for its promotional purposes without additional compensation, including posting in a winner’s list, except where prohibited by law, and Sponsor, Five Iron Golf, and their respective affiliates may be required to disclose the winner’s address to state regulatory authorities.

Privacy Notice: All information submitted in connection with this Giveaway will be treated in accordance with these Terms & Conditions and Five Iron Golf’s Privacy Policy.
